      Your Seafarers Employment Agreement (SEA)

      Your Seafarers Employment Agreement (SEA) is one of the most important documents you’ll receive. It sets out what the yacht is obliged to provide you under MLC 2006. Click here to find out more about what an SEA should include. Bear in mind that there is no one-size-fits-all version – each SEA will look a little different, so it’s worth reading yours carefully before signing. You are entitled to time to do this, and you should always keep a copy for your own records. Make sure every section is completed and that you are happy with the terms before you sign.

      Know Your Rights Under MLC 2006

      Every SEA must meet current applicable national laws and regulations, and where a Collective Bargaining Agreement may apply to them. Together, they should always meet or exceed the minimum standards set out under MLC 2006 – never fall below them.

      Flag States & MLC Compliance

      Not all yachts are required to comply with MLC 2006 – this depends on the flag state the vessel is registered under. If your yacht flies the flag of a country that hasn’t ratified MLC, it’s especially important that you’re fully satisfied with the employment agreement before signing anything.       Financial Protection

      We take reasonable steps, as far as practicable, to verify that the yacht is financially able to meet its obligations to you. That said, we would also encourage you to satisfy yourself on this during the interview process before accepting any position, and to make sure you ask the right questions to feel confident moving forward.

      Insurance Cover

      Your employer should provide adequate personal insurance cover for you during employment. If this isn’t in place, please raise it with us and we can point you toward recognised industry providers – though we don’t make specific recommendations or accept liability for third-party services.

      Our Commitment to You

      You should not be exposed to any form of exploitation by Superyacht Crew UK or its clients.

      Therefore:

      • We will never charge candidates any fees – before, during or after placement
      • We will never place anyone under 16 on a yacht, or under 18 in a Chef role
      • We will never use blacklists or any other means to prevent or deter qualified seafarers from finding employment

      Supporting Your Family & Next of Kin

      In line with our MLC 2006 obligations, we are here to support next of kin or concerned family members who need advice or guidance. If we receive a request of this nature, we will first take reasonable steps to verify the relationship is genuine. We will then notify the crew member of the concern and pass the family member’s contact details on to them directly – rather than the other way around – in order to protect the crew member’s personal information. To ensure we can do this effectively, we ask all crew to keep their personal contact details up to date with us at all times.

      Your Responsibilities When Registering With Us

      As a recruitment agency operating under MLC 2006, we are committed to placing only suitably qualified crew with our clients. By registering with Superyacht Crew UK, you confirm that all information you provide is genuine, accurate and a true reflection of your experience, training, qualifications and medical status.
      You are responsible for keeping us informed of any updates or renewals to your certifications, including medical documentation, as and when they occur. If you are successfully placed in a role, you will also be required to provide your employer, or their representatives, with your full certificates, training records, medical documentation and any other paperwork they may reasonably request.
      Providing false or misleading information is a serious matter.

      Complaints & Grievance Procedure

      Complaints about your employer or onboard conditions:
If you have a complaint about your employer or conditions onboard, follow the vessel’s onboard complaints procedure in the first instance. You can also contact the MCA directly at mlc@mcga.gov.uk or by post at 105 Commercial Rd, Southampton, SO15 1EG.
      Complaints about Superyacht Crew UK:
Complaints should be raised within 14 days of an incident, though we will consider extensions where there is good reason. You can complain verbally, in writing, or by email to our Director, Summer King at hello@superyachtcrewuk.co.uk. Verbal complaints will be recorded and a written copy provided to you. We aim to respond within 14 days. If a complaint remains unresolved, we will refer the matter to the appropriate flag state representative.
